Appointing a tutor for a minor

As parents, you are the legal tutors of your minor child. You may designate a substitute tutor in one of the following three ways:
- in a will
- in a statement to the Curateur public, if you are concerned about dying before your child
- in a mandate in case of incapacity
If one parent dies, the other parent may designate a tutor for their minor child. If both parents die or are unable to act as tutors, the courts will designate a tutor if you did not do so. A tutor must ensure the child’s protection, provide supervision, administer the child's property, exercise and defend the child’s rights, and see to the child’s education and well-being.
