Liquidator of a succession

Responsibility : Ministère de la Justice

When drawing up your will, you can name the liquidator of your succession (executor of the estate), as well as a substitute. On your death, the main tasks of the liquidator are to :

  • search for your will and have it probated, if necessary;
  • draw up an inventory of your property;
  • pay your debts;
  • file your federal and provincial income tax returns for the year of your death.

Note

Ask your liquidator whether he or she accepts that responsibility before entering his or her name. If he is not an heir, he is entitled to an amount of money to carry out his task. If he is the liquidator and an heir, he cannot demand remuneration, unless the other heirs agree.
